As an NRI, staying involved in your financial and legal matters in India can be challenging due to your absence. A Power of Attorney (PoA) simplifies this process. It is a legal document governed by the Indian Contract Act, 1872 and Powers of Attorney Act, 1882, which allows a trusted person (Grantee) to act on your behalf. From handling bank transactions to managing real estate, a PoA can address various challenges faced by NRIs
NRIs can choose between the following two types of power of attorneys based on their needs:
This grants the Grantee broad authority over various aspects, such as:
Operating bank accounts
Managing properties
Representing you in legal proceedings
You may include limitations or exclusions to define the extent of the power.
Used for a specific task like:
Selling a particular property
Handling a loan transaction
It is valid only for that particular activity and automatically lapses once the objective is fulfilled.
When you're not present in India, a PoA ensures continuity in your financial matters. You may authorise someone to:
Operate your bank accounts
Submit and sign documents
Manage loans or investment instruments
Execute local payments or tax-related tasks.
Both PoA and mandate holders serve a similar purpose but differ in legal standing:

Withdrawals are allowed for permissible local payments only
Repatriation of current income is permitted to the account holder
All remittances must comply with limits and conditions of repatriability

While a PoA offers great flexibility, it comes with certain risks. Here are a few safeguards:
Mention full details of both the Principal and Grantee
Define clear powers and limitations
Specify purpose, account details, and validity period
Set fund transfer limits and ask for regular reporting
Include a clause to cancel the PoA at any time
Being cautious and drafting a detailed PoA with legal guidance can protect you from misuse or misinterpretation.
Depending on your location, the process differs slightly:
Sign before a public notary
Pay applicable stamp duty
Register with the local Sub-Registrar if required
Get it notarised by Indian Embassy/Consulate or apostilled
Send it to India for stamping as per local Stamp Act
Register if applicable
